Divorce Litigation
While we strive at MSSG to settle divorce cases, sometimes a settlement cannot be reached through negotiation, and litigation is necessary.
We are experienced trial attorneys, having litigated cases throughout New York State involving the complex distribution of assets, the custody and care of children, and spousal and child support. Spousal and Child Support
Many cases include issues relating to spousal support (alimony) and/or child support. Such cases may require looking beyond a tax return to find unreported or hidden income, which may include funds received in cash payments or monies from a trust or third-parties. We at MSSG work closely with our clients and, where appropriate, forensic accountants, to understand the marital lifestyle and how it was funded, in order to determine the appropriate amount of support.

Child Custody Cases
At MSSG, we are sensitive to the effects of divorce on children, and strive to ensure they are shielded from any acrimony resulting from the break-up of a marriage.
We remain current on the literature involving child development and, when necessary, call upon professionals in the field to help our clients guide their children through this difficult period. Prenuptial and Postnuptial Agreements
We are often called upon to advise clients who wish to enter into agreements prior to or during their marriage. These agreements are known as prenuptial (before the marriage) and postnuptial (during the marriage) agreements.
Prenuptial agreements have become more commonplace for individuals who have acquired assets prior to marriage, are expecting to inherit assets, or are entering into second marriages, among other reasons.
Postnuptial agreements are often employed in those instances where there was insufficient time to complete a prenuptial agreement, where issues may exist in a marriage but the parties do not want to divorce, or in connection with estate planning.
Whether a prenuptial or postnuptial agreement, common goals can include asset protection, greater transparency and/or financial security. We work closely with our clients and, when necessary, their financial, estate and tax advisors, to craft agreements to achieve the desired objective.

Appeals
An appeal from an order or judgment can be taken when a client believes the trial court erred on the facts or on the law. At MSSG, we have successfully handled all aspects of appeals for both appellants (the party seeking to have an order or judgment changed) and respondents (the party seeking to keep the existing order or judgment in effect), including preparing the record, drafting and filing the briefs and arguing before the appellate court.
